According to the excruciation on whether “ strict punishment ” has the grounds , i have made this conclusion : we can increase the weight of punishment in legislation because of severe public order , but it must be restricted by the seriousness of crime , which means the punishment can not go beyond the horizon that the crime can permit . although , increasing the weight of punishment in judicature according to the situation is not true 通過對“嚴打”的配刑根據的考問,筆者得出如下結論:在立法上可以根據社會形勢嚴峻加重配刑,但這種加重又必須受到犯罪的嚴重性的限制,即不得超出犯罪的輕重所允許的限度;在司法上絕對不可以根據社會治安形勢加重配刑。因此,立法層面的“嚴打”是可以的,但必須受犯罪嚴重性的限制;而司法層面的嚴打是不正當的。
